Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Ody mobile application ("App") and any related services provided by Ody ("we", "our", or "us"). By creating an account or using the App, you confirm that you are at least 13 years of age and accept these Terms in full.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and truthful information when registering
- Keep your password secure and not share it with others
- Notify us immediately at support@odyapp.com if you suspect unauthorised access to your account
- Not create more than one account per person
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.
3. Use of the App
Ody is a personal fitness and nutrition tracking application. You agree to use the App only for its intended purposes and in accordance with all applicable laws and regulations.
You agree not to:
- Use the App for any unlawful, harmful, or abusive purpose
- Upload content that is offensive, defamatory, or infringes the rights of others
- Attempt to reverse-engineer, decompile, or tamper with any part of the App
- Use automated tools to scrape, crawl, or extract data from the App
- Impersonate another person or misrepresent your identity
- Interfere with the App's infrastructure, servers, or networks
4. AI Features
Ody includes AI-powered features including food scanning and body composition analysis. These features are provided for informational and tracking purposes only.
AI-generated results — including estimated nutritional values, calorie counts, body fat percentages, and lean mass figures — are estimates only and may not be accurate. They are not intended to replace professional medical, nutritional, or fitness advice.
By using AI features, you consent to relevant data (including photos and body measurements) being processed by our AI provider, OpenAI. Please review our Privacy Policy for full details on how this data is handled.
5. User-Generated Content
Ody allows you to create and share content including posts, photos, recipes, and comments ("User Content"). By posting content, you grant us a non-exclusive, royalty-free licence to display and distribute that content within the App for the purpose of providing the service.
You retain ownership of your content. You are solely responsible for any content you post and confirm that it does not:
- Infringe any third-party intellectual property rights
- Contain nudity, graphic violence, or sexually explicit material
- Harass, bully, or threaten other users
- Constitute spam or unsolicited advertising
We reserve the right to remove any User Content that violates these Terms without prior notice.
6. Health Disclaimer
Ody is a fitness and wellness tool and is not a medical device or service. Nothing in the App constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or health regimen, particularly if you have a pre-existing medical condition.
You use the App and act on its outputs entirely at your own risk. We are not liable for any injury, illness, or adverse outcome resulting from use of the App or reliance on its content.
7. Health Platform Integration
Ody may integrate with Apple HealthKit and Google Health Connect to read fitness and activity data. Your use of these integrations is subject to the terms of Apple and Google respectively. You can revoke this access at any time through your device settings.
8. Intellectual Property
All content, design, code, trademarks, and branding within Ody are owned by or licensed to us and are protected by applicable intellectual property laws. You may not reproduce, copy, or distribute any part of the App without our prior written permission.
9. Third-Party Services
The App relies on third-party services including Firebase (Google LLC) and OpenAI (OpenAI, L.L.C.) to function. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices or content of any third-party services.
10. Termination
You may stop using the App and delete your account at any time via the in-app account deletion flow or by contacting support@odyapp.com.
We reserve the right to suspend or terminate your access to the App at our discretion, with or without notice, if you breach these Terms or if we discontinue the service.
11. Limitation of Liability
To the fullest extent permitted by law, Ody and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, including but not limited to loss of data, personal injury, or property damage.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
For significant changes, we will make reasonable efforts to notify you within the App.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
